Fair Housing Act Discrimination Case
The United States District Court of Nebraska entered a consent order on March 3, 2010 in United States v. Latvian Tower Condo. Ass'n, Inc., (D. Neb). The United States initiated the action against the Latvian Tower Condominium Association and its president based on allegations of Fair Housing Act (FHA) violations. Specifically, the United States contends that the association discriminated on the basis of familial status in selling a condominium unit.
By adopting a Master Deed and Bylaws that prohibit children under the age of sixteen from residing in or occupying the units, the association and its president violated 42 U.S.C. § 3604(a). They also violated 42 U.S.C. § 3604(c) by publishing statements that indicate a preference in the sale of units based on familial status.
Under the terms of the consent order, Latvian Towers must pay $35,000 to the families it discriminated against as well as $15,500 in civil penalties.
